What usually happens when the ground does not match the tender
When ground conditions differ from what was assumed at tender — softer formation, groundwater, obstructions, contamination indicators or made ground — the dig rarely continues on the original method, price and programme without change. On commercial sites the practical sequence is typically: stop or protect the works, record what has been found, involve the designer (and often Building Control where foundations or drainage are affected), then agree a commercial and programme route before recommencing.

Why mid-dig ground change hits commercial packages hard
Groundworks sits early on the critical path. A formation that will not support the designed foundation, a trench that will not stay open, or material that cannot be reused as assumed can stop following trades even if the groundworks team remains mobilised. Soft spots, water and contaminated arisings also change temporary works, plant choice, muck-away classification and inspection hold points.
How the change is treated commercially depends on the contract, the quality of the tender information and what was written into exclusions and assumptions. That is project-specific — not a single industry rule.
Discoveries that most often trigger change
Typical mid-works findings include weaker soils than indicated, perched or rising groundwater, buried foundations or services, unexpected fill, hydrocarbon or asbestos indicators, and peat or organic lenses. Any of these may require revised excavation support, dewatering, disposal routes, formation improvement or a foundation redesign.
Proportionate ground investigation reduces — but does not eliminate — residual risk. Spot GI cannot describe every metre of a large site.

Commercial and programme pathway after discovery
Well-run packages treat discovery as a controlled change: record location and photos, notify the contract administrator or client team promptly, seek design instruction where permanent works are affected, and agree whether work continues under a defined provisional method or pauses. Under many NEC and JCT forms this becomes a compensation event or variation — the exact mechanism depends on the signed contract.
Disputes grow when teams dig on through uncertainty, or when tender packs were silent on residual ground risk. Early contractor involvement and clearer GI often reduce the size of mid-works surprises — see early contractor involvement.
The first response should be stop, record and escalate
When the ground changes mid-dig, the worst response is an undocumented workaround. The team should pause the affected activity, make the area safe, record what has been found and escalate to the designer, client or contract administrator according to the project procedure.
The record should be practical: location, depth, photographs, weather conditions, affected drawings, plant or labour standing, and any immediate safety or stability issue. That evidence helps the design team respond and protects the commercial discussion later.
Escalation does not always mean a major redesign. It may lead to confirmation that the existing design remains suitable, a local excavation instruction, a disposal change, a deeper foundation, a dewatering step or further investigation. What matters is that the decision is traceable.
The contract mechanism matters once the ground changes
Unexpected ground is both a technical issue and a contract issue. The team needs to know whether the event is a variation, compensation event, client risk, contractor risk, provisional quantity or excluded item. That answer depends on the tender information and contract terms.
If the tender clearly stated the ground assumption, the pathway is easier. If the tender was vague, the project may spend as much energy arguing about entitlement as it spends solving the ground problem.
Commercial teams should therefore check notice requirements early. Many contracts require prompt notice when conditions differ or extra work is expected. Missing the notice step can weaken an otherwise legitimate claim or delay instruction.
Programme recovery should follow the revised method
Once the changed condition is understood, the project should replan around the revised method rather than simply trying to catch up. Different ground may change plant, support, disposal, drainage, testing, inspection and sequence.
Recovery may come from opening another work face, resequencing plots, changing haul routes or instructing an enabling step. It should not rely on unsafe acceleration or covering up uncertainty before the design response is complete.
The best recovery plans are specific. They identify the affected activities, the new decision dates, the records required and the cost route. That gives the site team permission to move forward without losing control of the change.

- Confirm which GI reports are ‘for construction’ vs draft
- Agree formation acceptance and soft-spot rules in writing
- Identify who authorises method change on the day
- Pre-agree sampling / testing routes if contamination is possible
- Build programme contingency where residual ground risk remains
- Clarify disposal assumptions (reuse vs export) and who owns reclassification
